See how mistakes in the field can be costly in the courtroom. In the morning, learn about chronic due diligence failures to guard against, post-accident duties and oversights, costly investigative errors, dealing with the media and what to keep in mind if you ever have to testify in court.
In the afternoon, witness a hypothetical case demonstrating important lessons from the morning session - a live, unscripted demonstration of the lesson, just as it might happen in reality. Our panel will explain what is happening, why it is happening, and why it is important.
Workplace Alcohol and Drug Testing in Alberta: An Update Employers are in a hard spot when it comes to testing employees for alcohol and drug impairment. On the one hand, impaired workers represent a potential workplace hazard which must be identified and controlled by employers. On the other hand, human rights and privacy legislation restricts what an employer can do to identify and control the hazard. What is an employer to do? This 1.5 hour breakfast seminar will provide an overview of the issues and review some of the creative approaches recently taken by some employers in challenging the status quo – including using the criminal law. Two leading practitioners in this area, Hugh McPhail (Edmonton) and Phil Ponting (Calgary), will head this review panel and provide their insights into the problem.
OHS Liability Issues for Managing Subcontractors One of the biggest challenges for owners and contractors in recent years is managing their OHS liabilities stemming from unsafe or unlucky subcontractors at their work sites. This largely stems from the increased profile of OHS across the country and the hierarchy of accountability within OHS legislation. There are many pitfalls and ambiguities associated with this legislation and owners and subcontractors can be caught by surprise if their risk management systems are not designed with this in mind. An effective risk management system must take into consideration these pitfalls. This 1.5 hour breakfast seminar will provide an overview of those pitfalls and also take a brief look at how some organizations are addressing the problem.
Dealing with Worker Competency Issues One of the most common areas of OHS liability for employers is worker competency. If a worker makes a mistake at work and seriously injures someone, it is easy to conclude the worker was not competent to safely perform the work in question. This 1.5 hour breakfast seminar will review the legal test for worker competency and examine the three branches of the definition. The session will also review recent case law on the issue and identify some strategies that may help demonstrate to government investigators that a worker was in fact competent to perform the work.
Supervisor Liability for Managers and Safety Professionals This 1.5 hour breakfast seminar reviews the issue of personal liability for workplace accidents. The changing legal landscape on supervisor liability and safety professional liability require a greater awareness on the part of those supervisors and professionals with safety responsibilities. Recent case law has demonstrated that individuals will be held accountable for deficiencies which they are expected to control.
Health and Safety Legislation and Policy David Myrol helped develop the University of Alberta’s Health and Safety Legislation and Policy course with the Faculty of Extension. This three-day intensive course was designed along the same lines as the CRSP designation. It provides an in-depth examination of OHS legislation including the fundamentals of Canadian OHS law, the Canadian OHS legal framework, Bill C-45, the different types of regulatory offences, WCB legislation, and much more.
