Dismissal of Appeal on KMC Mining Lawsuit

Congratulations to Peter Taschuk and Don McGarvey on the dismissal of the appeal on the KMC Mining lawsuit. The Court of Appeal upheld the trial judge's finding that KMC was offered mining work with respect to the Muskeg River Project at a June 25th, 1999 meeting, that KMC accepted this offer, that this oral contract was later documented December 10 and that agreement was breached when the mining work was given to another contractor. The Court of Appeal also confirmed the trial judges award of damages, in excess of $30 million, to KMC for the losses associated with the contract, most notably the loss of mining work as caused by the appellants' breach of the contract.
