Breen v Foremost Industries Ltd., 2023 ABKB 552

Successfully defended an employer by establishing just cause to terminate its President and Chief Executive Officer and successfully counterclaiming (more than $500,000) for breach of fiduciary duty, fraudulent activity, breach of duties in managing international transactions, and punitive damages. The successful judgment was issued after a month-long trial and over 8 years of litigation. The issues in the trial included executive duties, contracts, and compensation, improper payments to the executive and others, breaches in entering a contract valued at over $11 Million in Russia, failure to obtain a foreign currency hedge, and the legal standing of different corporate entities to sue the executive.
