Klapstein and Bean established a company whose books showed debt owing to creditor in the name of Robert Ferry, though Robert and Linda Ferry, represented by Steve Livingstone, were not employed with the company at the time. The court held that Plaintiff failed to establish that Robert and Linda Ferry were a party to the alleged conspiracy. The claim against them was dismissed.
