Application for leave to appeal the Development Appeal Board's decision dismissing the applicant's appeal of the removal order. The applicant had obtained a building permit from the respondent to build a ramp in front of his house and the respondent issued a removal order two weeks after on the basis that the ramp encroached on public land. The applicant's boundary evidence was not available at the Board hearing and argued that the matter should be adjourned until the evidence was available. The applicant's real reason for the delay was that he did not prioritize the application and therefore the application was dismissed.
