McLennan Ross defended the individual investment advisor in relation to this proposed class action. Allegations were made both against the investment advisor and the Dealer. The defendants were successful in the Court of King’s Bench where the case management judge dismissed the Certification Application of the Plaintiffs. The Plaintiffs appealed to the Alberta Court of Appeal and the Court dismissed the appeal on several grounds including the fact that several of the allegations were largely individual in nature, so much so that they overwhelmed the proposed common issues and made the case unsuitable for a class proceeding. This case has since been cited in numerous class action proceedings in relation to the test for certification and how that test is to be applied.
