Plaintiff claims copyright ownership over seismic material deposited and that the copyright was breached without compensation or consent. The Defendants challenge this assertion and claim the Plaintiff does not have copyright control over the material. Twenty-five different actions were commenced in Alberta against various Defendants, including Husky. The court concluded that the seismic data is protected under the Copyright Act. The court also held that the Regulatory Regime creates a compulsory licence over the data in perpetuity after the expiry of the confidentiality or privileged period.
