Heikkila v Apex Land Corporation, 2014 ABQB 589

Plaintiff was injured while working on a roof, where he slipped and fell through plywood and became paraplegic. The plaintiff claimed Apex is liable on grounds of negligence, vicarious liability and breach of duty of care pursuant to the Occupier's Liability Act. The court determined that Apex was not negligent in the circumstances of this case. Apex was also found to be unable to be held vicarious liable, due to the nature of their relationship with the contractor that had been hired. Apex was found to have discharged its statutory duty as an occupier as to not be held liable under statute. The action was dismissed by the court.
