Imperial Oil (Applicants) sought judicial review of the Minister's decision claiming the decision to issue an order under s. 113 of the Alberta Environment Protection Enhancement Act was unreasonable. The order was an environmental protection order to remediate the site that had been used as a hydrocarbon refinery. Applicants contend that the Minister had applied s. 113 retrospectively, which was against the Act. The court decided the Minister's order was not unreasonable.
