Pipestone, Indyrock and Wells Trucking operated a gravel pit. Inyrock received information leading them to believe that Pipestone and Wells were receiving unfair preferential rates for gravel and attempted to order a remedy under oppression, and was removed as director. Indyrock, counseled by Stephen Livingstone, applied for relief under oppression remedy with the court. Counsel successfully demonstrated that the decision to terminate Indyrock constituted oppression. The application was allowed in part and Indyrock was reinstated as director.
