Marco advises and represents clients in relation to litigation and administrative law. He has appeared before all levels of court in Alberta, and many administrative tribunals including the Alberta Utilities Commission, the Municipal Government Board, and the Chartered Professional Accountants of Alberta Discipline Tribunal.

Marco represents clients in civil and commercial litigation. He has extensive experience litigating contractual disputes and negligence claims and has appeared before all levels of court in Alberta. His recent experience includes:

  • Defending an international engineering firm in relation to a gearbox failure.
  • Defending a commercial landlord in relation to the termination of a lease.
  • Representing an international oil and gas company in relation to a number of contract disputes.
  • Defending an auto upholstery company in a breach of contract action.
  • Preparing injunction materials on behalf of a federally incorporated power generator.
  • Defending an international oil and gas company in relation to a landspraying claim.
  • Acting for a business owner in relation to a shareholder dispute involving an international franchise.
  • Defending an accounting firm in a negligence action concerning the preparation of a corporate income tax return.
  • Defending a commercial landlord in relation to a contaminated site claim.
  • Defending an international accounting firm in a multi-million dollar action alleging corporate successor liability.
  • Defending a quantity surveying firm in a number of negligence actions.

Marco routinely represents clients in municipal matters involving the Municipal Government Act. His recent experience includes:

  • Defending a food processing facility subject to a stop work order issued by a municipality.
  • Defending planning decisions of a municipal Subdivision Appeal Board before the Alberta Court of Appeal.
  • Advising a Municipal Planning Commission on decision drafting.
  • Defending an application to disqualify a councillor due to an undeclared pecuniary interest.
  • Defending a trip and fall claim alleging municipal liability for a dangerous sidewalk.
  • Advising a Municipal Planning Commission on procedural fairness issues.
  • Advising a Municipal Planning Commission on a NRCB decision regarding confined feeding operations.
  • Drafting CRTC submissions on behalf of a municipality in relation to the routing of fiber optic cables.
  • Acting on behalf of a Composite Assessment Review Board in a judicial review application.
  • Assisting a town in an intermunicipal dispute before the Municipal Government Board.

Marco assists clients a wide variety of employment matters including drafting and reviewing employment contracts, workplace policies, workplace investigations, progressive discipline, terminations, human rights complaints, and privacy issues. His recent experience includes:

  • Advising an international airline in relation to Canada Labour Code compliance.
  • Defending wrongful termination claims on behalf of a national construction company.
  • Defending a human rights claim on behalf of an auto body shop.
  • Representing a number of doctors wrongfully terminated by a medical clinic.
  • Defending an international oil and gas company in relation to a pension dispute.
  • Acting on behalf of an international restaurant chain in relation to a for cause termination.
  • Acting on behalf of a university in relation to a labour grievance.

Marco has experience assisting clients in environmental and regulatory matters. He has prepared materials in relation to oil and gas facilities, mining projects, and electric power facilities. He has appeared before the Alberta Utilities Commission and assisted with the preparation of materials for submission to the Alberta Energy Regulator, the National Energy Board, and the Surface Rights Board. Marco has experience:

  • Advising a corporation in relation to the termination of a road use agreement.
  • Advising an international energy company in relation to reclamation liability in the context of a facility sale.
  • Advising a power generator in relation to transmission rights in various energy markets.
  • Advising a landowner in relation to a lease dispute and preparing materials for a hearing before the Surface Rights Board.
  • Assisting a developer in an Alberta Utilities Commission hearing in relation to the routing of a transmission line through a new subdivision.
  • Advising a mining corporation concerning the mechanics of the surface rights application process.
  • Preparing injunction materials for an energy generator in relation to the construction of a transmission line crossing an Indian Reserve.
  • Preparing application materials concerning a Request for Regulatory Appeal before the Alberta Energy Regulator.
  • Representing landowners in windfarm applications before the Alberta Utilities Commission.
  • Advising the province in relation to its engagement strategy with respect to a major project subject to NRCB and IAA review.
  • Advising an Alberta power generator in relation to a line loss dispute.

Marco advises national and international insurers on risk, both as defence and coverage counsel, in relation to auto, carrier, property, products liability, commercial liability, professional liability, and life insurance claims. In his capacity as defence counsel, Marco has assisted in the representation of individuals, insurance brokers, ranchers, property managers, architects, engineers, quantity surveyors, malls, accountants, manufacturers, restaurants, trades and sub-trades, among others. In the coverage context, Marco has extensive experience:

  • Drafting coverage opinions.
  • Determining claims limitations and notice provisions pursuant to the Insurance Act and Fair Practice Regulation.
  • Investigating and denying fraudulent claims.
