James Lingwood represented the Defendant in an application by the Defendant to have the Plaintiff’s lawyer of record removed. The lawyer in question had previously acted for the Defendants in a similar action. The application was granted. The Court found that the lawyer had received confidential information from the Defendant during their first relationship which would be relevant in the present action. The lawyer was removed from acting for the Plaintiff.
