Dingwall v Foster, 2012 ABQB 476

Plaintiffs applied to seek summary judgement to enforce a judgement from Nevada, in Alberta, for an amount of $3,660,084.74 USD. The court determined the summary judgement to the plaintiffs was to be granted once they had dealt with several issues. This included the issues of the Nevada corporation petitioning into bankruptcy in Nevada. The court must determine whether the corporation still exists, and if it has a beneficial interest in the damages awarded. The court determined the implications with the bankruptcy must be dealt with before the issuing of the final summary judgement.
