Part of the team that represented the School Board. The teacher had been terminated for refusing to follow the direction of his superiors to use grading codes that would provide students and parents with information about why an assignment was not completed. In dismissing the appeal, the Court found while the teacher had committed some of the alleged acts, he was “a professional employee who had legal obligations to his students and would be expected, and entitled, to exercise his professional judgment regarding the best interests of his students.” The School Board successfully argued against the teacher’s cross-appeal, which was dismissed.
