Cessco Fabrication & Engineering Ltd. v International Brotherhood of Boilermakers, Iron Ship Builders, Blacksmiths, Forgers and Helpers, Local Lodge No. 146, 2020 CanLII 84478
| Alberta Labour Relations Board
The Employer made certain applications to the Alberta Labour Relations Board in the context of a lengthy strike and picket line activity. There were several applications made by the employer to attempt to regulate the actions of unionized workers on strike (i.e. on the picket lines). In this case, the employer successfully utilized an infrequently process under s. 11 of the Labour Relations Code which enables the Chair of the Board to conduct an informal hearing, attempt settlement, and then make a report to the board of the Chair’s recommendations. Using this process, the employer successfully obtained an order from the Board which adopted the recommendations by the Board Chair to govern the conduct of the striking workers and the employer at the picket lines.
